Nikota Service Agreement

The Nikota Service Agreement (hereinafter referred to as "this Agreement") is an agreement between you and nikotapower.net (hereinafter referred to as "Nikota" or "us") regarding the use of Nikota products, applications, and other services (hereinafter referred to as "this Service").

Nikota hereby reminds users that you must carefully read and fully understand the terms of this agreement, especially the clauses exempting or limiting liability, legal application, and dispute resolution. Please pay attention to accessing and/or using Nikota products, programs, and services (such as copying any information, registering as an APP user, etc.), which means that you have fully read, understood, and accepted the entire content of this agreement, and have reached an agreement with Nikota, Become a Nikota user. 1、 Scope of Agreement

However, we cannot fully guarantee that the terms of this agreement fully cover all the rights and obligations of you and Nikota, nor can we guarantee that they fully meet the needs of development. Nikota's legal statements, privacy policies, product usage terms, product manuals, notices, announcements, operating rules, help documents, and warm reminders are all supplementary agreements to this agreement, and are inseparable from this agreement and have the same legal effect. If you use our services, it is deemed that you agree to the supplementary agreement mentioned above.

2、 Nikota Account Application and Usage

When using some of Nikota's features, you may need to register a Nikota account. When creating an account, you must provide true, current, accurate, and complete information, and update your information as necessary to maintain its authenticity and accuracy. You have the responsibility to protect the security of your password and are responsible for the behavior on your account. You may be responsible for any losses caused to us or others due to unauthorized use. If you discover any security issues or unauthorized use of your account, you should immediately notify us.

3、 Information and Services Provided by Nikota

The product/service promotional content, parameters, and other product/service information on Nikota are subject to change at any time. Although we will make every effort to ensure the accuracy of the product/service information you browse, due to objective reasons such as internet technology and market factors, the information displayed on the platform may have some lag or errors. You are aware and understand this situation, and agree not to hold Nikota liable for breach of contract or infringement. If you find that the product/service information is incorrect or has any questions, please do not accept the service and contact us.

You agree that Nikota has the right to inform you of our company's product and service information through email, text message, phone, and other means.

4、 User provided information

You must ensure that the information you provide to Nikota:

Correct, complete, true, and legal;

You own or control all rights to any content contained in user uploaded information, and will not infringe any intellectual property rights or any rights of third parties;

There is no false, fraudulent, harassing, defamatory, insulting, intimidating, vulgar or obscene information or content that violates the law, public order, good customs, or social ethics;

There are no viruses, Trojan programs, or other computer software, documents, or other data materials that pose a threat to the security, integrity, stability, or continuity of the network or computer system;

We will protect the personal information of users involved in the information provided by them in accordance with the Nikota Privacy Policy.

You agree to grant Nikota the right and license to use, copy, modify, disseminate, and display user provided information for free, permanent, and irrevocable worldwide.

5、 Intellectual Property

All content included in this service, including but not limited to text, images, music, videos, animations, trademarks, patterns, charts, visual interfaces, data, and computer coding (the "Content"), is owned by Nikota or legally authorized for use by Nikota. Unless otherwise specified in writing, without Nikota's prior written consent, no content on this service may be copied, modified, disseminated, distributed, reprinted, played, disassembled, reverse engineered, decompiled, connected or transmitted via a hyperlink, stored in an information retrieval system, or used in any other way.

All trademarks and logos used and displayed in this service belong to Nikota or its licensors. Any content contained in this service shall not be considered as granting any license or right to use any of the aforementioned trademarks or logos without the written permission of Nikota or other parties, by implication, without objection, or in any other form. Without prior written permission, no one shall use Nikota's name, trademark, or logo in any way.

6、 Usage restrictions

Nikota has the right to refuse to send prohibited goods to countries, regions, and any institutions or individuals blacklisted by the United Nations, the United States, the European Union, and other countries. At the same time, you are not allowed to use any products produced or sold by Nikota for any military purposes, support terrorism, nuclear facilities, biological or chemical weapons, missiles, weapons of mass destruction, etc.

You must comply with any and all applicable domestic and international export control laws and restrictions, including any restrictions regarding destination, end users, and end use. We reserve the right to suspend, restrict or terminate your access to this service or any part thereof for the purpose of complying with any such export control laws and restrictions.

7、 Disclaimer

Our services, including but not limited to websites, materials, user submitted information, any products or services provided on our services, and all information, software, facilities, services, related communications, and other content, are provided on an "as is", "available", and "without warranty of flawless" basis.

8、 Force majeure and other reasons

Nikota fulfills relevant obligations in accordance with the law, but we do not assume any liability for breach of contract due to obstacles, defects, delays, or changes in performance content caused by the following reasons:

Due to force majeure factors such as natural disasters, strikes, riots, wars, government actions, judicial administrative orders, etc;

Service interruption or obstruction caused by public service factors such as power supply failures, communication network failures, or any other reasons such as hacker attacks, invasion of computer viruses, shielding of illegal content information, harassment information, government regulations, and any other network, technology, communication lines, information security management measures that cannot meet your requirements;

Due to routine or emergency equipment and system maintenance, equipment and system failures, network information and data security, and other factors, while we have done our utmost in good faith management.

9、 Change of terms

Nikota may modify this agreement from time to time based on changes in national laws and regulations, as well as the need to maintain transaction order and protect consumer rights. It is your responsibility to regularly review the changes to this usage agreement. If you continue to use this service after publishing the changed information, it means that you agree and accept the change. If you still do not agree to the effective change, you should stop using this service from the effective date of the change.

10、 Termination of Agreement

Nikota has the right to restrict all or part of your permissions or cancel your Nikota account when any of the following situations occur:

Affects the normal operation of websites and applications or affects the provision of services to other users through network attacks, mass advertising, and other behaviors;

Repeatedly posting information unrelated to the products or services sold in the comment or consultation section, or maliciously making negative reviews multiple times, violating the platform's credit rating system;

You have engaged in other illegal activities that affect the normal operation order of the platform.

11、 Application of legal jurisdiction and others

This agreement shall be governed by Chinese law. Any disputes arising from or related to your use of Nikota products or services should be resolved through friendly negotiation with us.

This usage agreement is signed in Shenzhen, Guangdong.

Other rights not explicitly authorized are still reserved by Nikota, and you must obtain our written permission separately when exercising these rights. Nikota's failure to exercise any of the aforementioned rights does not constitute a waiver of such rights.
